RECENT CASE! State v. Hill, Gwinnett County State Court, 9/29/09: Hill was stopped for an expired tag. The officer alleged that he smell a strong order of alcohol on the breath of Hill and asked Hill to step out of the vehicle and perform several field sobriety tests. According to the officer, Hill did poorly on the tests. Hill was arrested but did not submit to the State administered breathalyzer. Prior to the stop, Hill was not observed operating the vehicle in an unsafe manner. Nor did Hill's appearance, demeanor or behavior indicate that he was under the influence of alcohol to the extent he was a less safe driver. After a jury trial, Hill was found NOT GUILTY!
